By accessing or using the Wheelly platform, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Eligibility
To use Wheelly services, you must:
- Be at least 21 years of age
- Hold a valid driver's license
- Have a valid form of payment
- Agree to all terms and conditions
3. Account Registration
You must register for an account to use certain features of our platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Vehicle Rentals
When renting a vehicle through Wheelly:
- You agree to use the vehicle only for lawful purposes
- You must return the vehicle in the same condition as received
- You are responsible for any damages during the rental period
- You must comply with all traffic laws and regulations
- Smoking is prohibited in all rental vehicles
5. Payments and Fees
By using our platform:
- You agree to pay all applicable rental fees, deposits, and charges
- A 10% service fee is charged on all completed transactions
- Late returns may incur additional fees
- Cancellation fees may apply based on timing
6. Car Owner Responsibilities
If you list a vehicle on Wheelly:
- You must provide accurate vehicle information
- Your vehicle must be properly insured and roadworthy
- You must respond promptly to booking requests
- You agree to the 10% service fee deduction
7. Insurance
All rentals must have appropriate insurance coverage. Wheelly is not responsible for accidents, theft, or damages during the rental period. Users are encouraged to purchase additional coverage as needed.
8. Limitation of Liability
Wheelly acts as a platform connecting car owners and renters. We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of our platform or vehicle rentals.
9. Prohibited Activities
You may not:
- Use the platform for any illegal purpose
- Provide false or misleading information
- Attempt to circumvent our payment system
- Harass or harm other users
- Violate any applicable laws or regulations
10. Termination
We reserve the right to suspend or terminate your account at any time for violations of these terms or for any other reason at our discretion.
11. Changes to Terms
We may modify these Terms and Conditions at any time. Continued use of the platform after changes constitutes acceptance of the new terms.
12. Cancellation and Termination Policy
12.1 Purpose
This policy outlines the rules for canceling bookings, terminating rentals, and suspending or terminating user accounts on the Wheelly platform. It applies to both Rentors and Rentees.
12.2 Cancellation by Rentee
Advance Cancellation:
- Rentees can cancel a booking before the scheduled rental start time.
- Refunds are issued based on the time of cancellation:
- More than 24 hours before start: Full refund minus any applicable service fees.
- Less than 24 hours before start: Partial refund (percentage determined by Wheelly policy).
No-Show:
- If a Rentee does not show up or fails to collect the vehicle without notice, no refund is provided.
Cancellation Process:
- All cancellations must be processed through the Wheelly app or website.
- Direct cancellations outside the platform may not be recognized or refunded.
12.3 Cancellation by Rentor
Advance Notice:
- Rentors must provide timely notice if a booking cannot be fulfilled.
Refund to Rentee:
- If a Rentor cancels a confirmed booking, the Rentee is entitled to a full refund, including any service fees paid.
Penalties for Frequent Cancellations:
- Rentors with repeated cancellations may face account suspension or removal from the platform.
12.4 Termination of Rentals
By Rentee:
- A Rentee may terminate a rental early if the vehicle is unsafe, not as described, or mechanical issues arise.
- Refunds for early termination will be calculated based on the unused rental period, minus any applicable fees.
By Rentor:
- Rentors may terminate a rental if the Rentee violates the rental agreement, engages in illegal activity, or damages the vehicle.
- Early termination by Rentor must be reported to Wheelly immediately. Refunds will be determined on a case-by-case basis.
12.5 Termination of User Accounts
Wheelly may suspend or terminate a user account (Rentor or Rentee) in the following situations:
- Violation of Wheelly policies or agreements.
- Fraudulent, unsafe, or illegal activity.
- Repeated failure to honor bookings or payments.
- Behavior that jeopardizes the safety or reputation of the platform.
Account termination may result in loss of access to bookings, funds, or platform services.
12.6 Refunds and Disputes
- Refunds are issued through the Wheelly platform according to the cancellation or termination policies.
- Any disputes regarding cancellations, early termination, or refunds should be submitted via Wheelly's support system. Wheelly will review and resolve disputes in accordance with platform policies.
12.7 Policy Updates
Wheelly reserves the right to update this policy at any time. Users will be notified of major changes via app notifications, email, or website updates.
